Many senior adults require some degree of caretaking as their physical and mental faculties decline. Caretakers may also be a family member, friend, or other acquaintance who helps a senior manage their affairs. There are remedies available to the person with diminished capacity who has been financially exploited. The problem is to convince the person to bring or consent to an action against the perpetrator and to prove that a transfer of an asset to a perpetrator was not a gift to, or compensation for, services rendered by the perpetrator or that an estate planning document is invalid. The act requires the department to notify law enforcement if there is a reason to believe that abuse, neglect, or exploitation has occurred.

CLSMF Elder Advocates also help seniors with other concerns relating to matters such as living wills, financial scams, health care, and durable powers of attorney. The Elder Advocate will meet with the individual in his or her home or wherever is convenient for the individual. There is no requirement that crimes against the senior have been reported to the police to receive our assistance.
Currently filed with the Florida House of Representatives and the Florida Senate are bills that relate to the protection of senior and vulnerable investors. Although they are similar, the bills are not identical. The differences between the two bills are discussed below.

Neglect is an error by a caretaker which is a serious disregard of responsibility. Exploitation is the act of taking unfair advantage of a person by a caretaker. In the State of Florida, allegations of abuse, neglect, or exploitation are primarily investigated by the Department of Children and Families DCF after receiving a complaint from the Florida Abuse Hotline.

Neglect: failure or omission on part of caregiver or vulnerable adult self-neglect should also be reported to provide care, supervision and services necessary to maintain the physical and mental health of the vulnerable adult. DCF will refer such caregivers to the potential services available to them to assist in caring for the vulnerable adult.
